There are those who can’t imagine why Anwar Ibrahim ignores the call for him to swear on the Quran in a mosque that he is innocent of the allegation of sodomy and also why Raja Petra Kamarudin ignores Malaysian courts.

On the Anwar issue, first of all, there is no such thing as swearing on the Quran in Islam and many religious scholars and leaders have said so quite explicitly. Why these people still insist that Anwar do so is perplexing. Read our lips: THERE IS NO SUCH THING AS SWEARING ON THE QURAN IN ISLAM. Let’s hope these sorry excuses for Muslims hear us loud and clear this time.

Secondly, Mohd Saiful Bukhari Bin Azlan, IC No: 850706-01-5687, of No. 29, Jalan BU 7/6, Selangor, swore on the Quran at 6.00pm on 15 August in the Federal Territory Mosque in front of Ramlang Bin Porigi, UMNO Member No. 03405853 of Cawangan Seri Macang, Bahagian Bukit Mertajam, Parlimen Permatang Pauh.

Can you now see the comedy of the whole thing? Ramlang Porigi, the so-called ‘Imam’ who conducted Saiful’s swearing on the Quran, other than possessing a name that sounds like an illegal Indonesian immigrant who has just been given a ‘blue’ IC, is an UMNO member from Permatang Pauh. Any wonder why Anwar ‘tak layan’ this whole matter? It was all a circus show for the benefit of the Permatang Pauh voters.

Now, with regards to the Raja Petra issue, today’s story from Bloomberg says it all. Before that, however, let us reveal what happened to Raja Petra in April 2001 and why he no longer ‘layan’ Malaysian courts.

Raja Petra was detained under the Internal Security Act on 11 April 2001. The Special Branch then demanded that he hand over his international passport. But Raja Petra did not have his passport with him. It was lodged at the British High Commission and there was no way the Special Branch could get its hands on it.

The Special Branch demanded to know why his passport was not in his possession but was instead with the British High Commission. Raja Petra refused to reveal the reason. “Never mind,” the Special Branch told him. “We have other ways of blocking your passport.”

Three days later, on 14 April 2001, the day of Raja Petra’s wedding anniversary, a letter was dropped into the letterbox of his house giving him 14 days to contest a bankruptcy order. Since he was under 60 days ISA detention he certainly could not make an appearance in court within the stipulated 14 days to contest the bankruptcy order. Anyway, the bankruptcy order was not served on him but was dropped into the letterbox.

Raja Petra was released from ISA detention on 6 June 2001. A few weeks later, he went to meet Manjeet Singh of Sri Ram & Co. to try to get them to set aside the bankruptcy order. Sri Ram & Co. checked with the courts and discovered that the whole file had disappeared. There was no way they could contest the order, Manjeet told Raja Petra, since the file had disappeared. Anyway, Manjeet told him, once bankruptcy has been obtained you can’t apply to set it aside. You are supposed to contest the order within the 14 days given to you. The fact that one is under 60 days detention and there was no way one could appear in court to contest the order does not change the decision of the court.

Since then Raja Petra ‘tak layan’ Malaysian courts. Malaysian courts do not dispense justice. They serve their political masters.

Anwar Sex Case Puts Malaysian Courts on Trial as Election Nears

(Bloomberg) -- The first time Anwar Ibrahim, Malaysia's former deputy prime minister, was accused of illegal sex with a man, the court proceedings so dismayed a Universiti Malaya law lecturer that he told his students to throw away their textbooks.

“What's admissible is irrelevant, what's relevant is not admissible,” retired High Court Judge Shaik Daud Ismail said he told his class after the trial that convicted Anwar started in 1998.

A decade later, with Anwar facing similar charges, Shaik Daud, 72, says Malaysia's judiciary still needs reform. “The system is crooked,” said Shaik Daud, who calls himself politically independent.

Anwar, 61, served six years in prison before his conviction was overturned in 2004. Now leader of the opposition, he says the new case was fabricated to stop him from ousting the ruling coalition that banished him the last time he was accused. Deputy Prime Minister Najib Razak, Anwar's rival to succeed Prime Minister Abdullah Ahmad Badawi, denies that.

Lashing back, Anwar last month helped publicise a private investigator's accusation that Najib had an affair with a woman before she was murdered. Najib, 55, denied ever meeting her. The investigator retracted the claim a day later.

The counter-allegations are testing a judicial system that even Abdullah has said some Malaysians see as corrupt.

Liable to Manipulation

“The system is liable to manipulation,” says Abdul Aziz Bari, an International Islamic University Malaysia law professor. “I am not sure whether it is good enough to handle all this.”

Malaysia's chief justice, Abdul Hamid Mohamad, declined to be interviewed for this story.

Anwar pleaded not guilty on August 7 to having sex with a 23- year-old man who worked for him. He's accused under a law barring sodomy, defined as 'carnal intercourse against the order of nature’. Violators face up to 20 years in prison.

Free on bail, Anwar plans to win a seat in an August 26 parliamentary by-election and then persuade enough ruling-coalition lawmakers to join his opposition to oust Abdullah. In March elections, opposition gains left the ruling coalition with its smallest majority since independence from Britain in 1957.

In Malaysia, King Mizan Zainal Abidin appoints judges on the advice of the prime minister. Judges, not juries, deliver verdicts after hearing evidence from prosecutors and the defence.

Dismissed Judge

The judiciary lost credibility in 1988 when then-King Sultan Iskandar Ismail dismissed Salleh Abas, Malaysia's chief judge, on instructions from a tribunal set up by Mahathir Mohamad, prime minister at the time. Mahathir denied involvement in the decision, which followed a High Court ruling that his party was illegal because some regional branches weren't properly registered.

In another 1988 move that critics say compromised independence, the government changed the constitution to allow federal law, rather than the constitution itself, to determine the reach of judicial power.

“The amendment disturbs the concept of the separation of powers,” the International Bar Association and other lawyers' groups said in a 2000 report. “It tends to make the judiciary an arm of the legislature, an instrument of the executive.”

The handling of the Anwar sodomy case raised further doubts. As deputy leader from 1993 to 1998, he and Mahathir had clashed over the Asian financial crisis.

Deja Vu

As that rivalry heated up, Anwar was accused of sodomy with a man. Anwar successfully argued on appeal that the trial judge disregarded exculpatory evidence: A prosecution witness changed the alleged offense's date. A policeman said Anwar's DNA could have been ‘planted’ on a mattress. The chemist who testified he found the DNA said he destroyed it.

“The case was embarrassing and did a lot more damage to Malaysia's judicial-system image than it did to Anwar,” says Robert Broadfoot, managing director of Hong Kong-based Political and Economic Risk Consultancy Ltd. “There's the suspicion of political influence. Is this deja vu all over again?” he added, referring to the new case.

As opposition leader, Anwar criticises the system. Last year, he released a secretly filmed video showing a lawyer claiming to know about future judicial appointments during a phone call with a judge.

Chronic Backlog

A royal inquiry found that the 2001 recording suggested an ‘insidious movement’ to influence appointments. Abdullah, 68, in March responded by appointing Senator Zaid Ibrahim to push through reforms. “The 1988 ‘crisis'’ still haunts us,” Abdullah said in April, promising a new commission to vet judge candidates.

“The legal sector has been neglected,” said Zaid, a former lawyer. Judges are paid too little and face a chronic case backlog.

There are 903,000 outstanding cases in Malaysia, state news service Bernama said on June 3. Malaysia's chief justice, Abdul Hamid, earns RM424,314 ($127,441) a year, including perks, according to the Malaysian Bar Council. In the U.S., Chief Justice John Roberts will be paid $217,400 this year.

Abdullah's vetting commission probably won't start work until 2009, and how much authority will rest with the premier remains undecided, Zaid said.

“I question whether the prime minister should be given the sole prerogative on picking judges,” said Gobind Singh, an opposition lawmaker. “That allows for an ultimately biased judiciary.”

Any legal shakeup should include the police, said Tunku Abdul Aziz, a member of a 2004 royal inquiry into Malaysia's police.

In 1998, Anwar was beaten by Malaysia's police chief, Abdul Rahim Noor, who was sentenced to two months in prison for the attack. Malaysia has yet to create an independent police complaints commission, the inquiry's main recommendation.

“We discovered that every level of the police service was tainted by corruption,” Abdul Aziz said.

When the government of this country is corrupt, dont expect everything else to be clean! Perhaps this is the only country in the world where the people are in the opposing side of the government. All the rest of the regimes in the world have been eradicated. In Malaysia, the police, military, judiciary etc are on the side of the government. The people only have the likes of Anwar and RPK etc. Can they win? Are the people willing to die for the future generation?

I percieve a new approach on all these hot current issues of the day. And Shafee Abdullah can contine to grind his teeth or denture. Keep on suing. Pile up the outstanding court files. Some go missing. Others remain unheard for years. They change the presiding judges. Some judges could only preside partially-heard cases before their transfers. Yet some may have retired even before judgments are delivered. Or they change the laws with retrospective effect. Such is the state of the Judiciary and our Democracy. They both deserve a 'Gold' in the Olympics. Malaysia Boleh.

I don't think reforming the Judiaciary will ever be perfected under the present govt.The same thing goes to the ACA.

The time tested way for everything to fall in place is to change the BN gomen. Look at Thailand now. The only different is they have a very strong and independent Monarchy system. So, vote for PR, if you want changes.

The state of the law and order system broke down some 20 years ago. RPK was served a bankruptcy order in a letter box...there have been times when it was served on the road side, in newspaper columns, on mother in laws, on the floor of a courthouse and even on someone residing overseas as in Amin Shah's case which makes you wonder if the order is valid....and our dundu lazy judgs who cant read or write properly will just dish out the order....so forget about the law in this country....its a gone case.....from HP6 graduates being churned out by UIA and UiTM ......the government long ago already decided that justice was of minor importance probably because they too didnt want to play by the rules as in RPK's ISA/bankruptcy case.....investors who lost money through crooked judgments dished out by our manipulative courts have long since bolted.....Malaysia today now ranks as a banana republic....and the Singaporeans are having a good laugh....

Although, I too will like to trust God only, but being a mere mortal I have to submit to the kind of justice dispense by our Malaysian courts.
And, I fear Anwar will be brought down by this judicial pursuit.
By tying him up with legal judgements, his agenda for change with be held in check while the UMNOputras continue to plunder the country's wealth.
I hope my pessimistic outlook will be be proven wrong and like the escape artiste of magic shows, Anwar will come out triumphant!!

Yes Sir, Don't layan any, may it be Fools, Corrupt Authorities or even the lopsided judgement dispensing Courts that does not dispense Justice at all.

I, too have a huge axe to grind plus a few bones to pick with regards to our judicial system, but that's my sob story that might not even surface on a rainy day nor season.

Our focus, henceforth, should be to get our brother, YAB DSAI into Parliament first, and then, The MT Community aka The Barisan PRO-RAKYAT will be able to rejoice to the fullest come next week.

Folks, you may naively ask why. Read on, please.

The day when YAB DSAI walks into Parliament as a Member of Parliament after a forced hiatus of 10 years, we all believe that the that would follow would indeed .

My current humble prayers including, I'm sure, that of millions of our Malaysian Bro's and Sisters are that, as soon as he takes his oath, those BN MPs get up and come over to the Pakatan Rakyat's side, hence, giving the impetus and proof, that the BN Government is henceforth, for good.

Then, YAB DSAI would being the first MP to walk in as one MP but 6th PM OF MALAYSIA with Seven Sense, God Willing.

I must have missed the Bloggers'Team from KL in PP by a metaphorical mile and hour. Looking forward to meet you guys and gals come next Friday in PP.

It should now be known as the "]FRANKFURT CONSPIRACY"

How so?

This case is charged under consensual sex, and whilst keeping Saifool under close supervison for so many donkey-ed days, Saifool claims it was without his consent, yet gomen went ahead and seek justice for Saifool under consensual sex; therefore it is known meaning the gomen is now in another situation of having too much in their mouth.

Now, the kangaroo court stil claims consensual sex means Saifool must have been teasing Anwar. AND so Saifool was and kena proper or properly, and in all, 8 times on his sorry arse is not good enough for him he has to go and tell this very kind submarine guy about his experiences;

Admist the big fanfare,The Americans, Asians and everybody is taking an intense interest in this whole issued and being the TAIKOR of the known free world, American sends the strongest signal yet, they are not too happy, and neither should we be.

Meanwhile, the TAX PAYERS get rip off, paying for this malicious dark comedy and is feeling the strained full effect over and over again.

I read with utter disgust in Malaysiakini that large screens have also been placed at strategic spots throughout the constituency showing the infamous oath-taking ceremony.

The propaganda and brain washing strategy will work absolutely. I have written something it herehttp://humblevoice.blogspot.co...brain.html. Many people of Permatang Pauh will get affected to one degree or another by the shameless bombardment of such blatant lies. It will win BN some votes in the by-election. But it will cost the country heavily in the eyes of international communities, and it will cost BN heavily in the rest of the country. But the BN idiots are simply too dumb and too desperate to have to resort to such disgusting techniques.

I am truly to be ashamed to be a Malaysian today.

NST--Datuk Harussani Zakaria says an accuser must present four witnesses; while Dr Mohd Asri Zainul Abidin says what Mohd Saiful had uttered in the mosque was in accordance with the teachings of Islam but swearing on the Quran was not necessary.

Saya SAI-FOOL Bin BUKHARI meminta ALLAH membuka Mata dan Minda MUFTI Perak yang Bebal kerana beliau pernah mengeluarkan Fitnah Besar bahawa Gereja di IPOH sedang membaptiskan penganut Islam dan seterusnya mencetuskan kekacauan di perkarangan Gereja.Beliau belum memohon Maaf secara terbuka kepada semua penganut Kristian atas tindakan beliau yang Bebal itu!!Beliau telah terpedaya dengan begitu mudah oleh seorang perempuan yang kurang siuman yang berani bertuduh yang bukan-bukan!!

What is happening in Malaysia today is what has happened in Zimbabwe, where despite wholesale intimidation and fraud, Mugabe and his ZANU-PF fascists were voted out. Unfortunately Mugabe's fascists were able to hold onto power as the army, police and other paramilitary forces are all under the control of Mugabe stooges.
It is fortunate that in Malaysia, the Armed Forces, excepting the Polic Raja Di Malaysia, swore their loyalty and duty to the Pertuan Agong and the Minister of Defence is the administrative head. This small difference may be what save Malaysia from the fate that befell Tsvangarai supporters in Zimbabwe, where Mugabe stooges took up arms against the defenceless Zimbabweans that voted for change.
I fear that DSAI and PR still have a long way to go before they can assume control of the Federal Government. Corruption is THE modus operandi in Malaysian politics and government that if DSAI and Malaysians want a full accounting of the corruption, it will take Malaysia at least long years and tens of thousands of cases in court to clear. By then, Malaysia may be an economic and strife driven country like Zimbabwe.
The best way forward is for DSAI and PR to convene a Truth and Reconciliation Committee for Corruption like what South Africa did for Apartheid, where corrupt practices as a byproduct of the system in place can be pardoned upon return of the loot. It is either that or we Malaysians will continue fighting among each other, PR against BN, to no end.

Our anger and vengeance will not create a better Malaysia, our forgiveness and the repentance of the corrupt WILL. It may not be the popular thing to do but it is the right thing to do.

First, one of my friends informed that his Chinese dialect for "Saiful" can mean:
1) Sai-ful= Shit-Pool/hole
Just an interesting and very apt translated name!

So, that Saiful is just full of shit! I wonder what happened during that 3 hours questioning of Sai-ful by JIWI yesterday! Anybody know anything about that?


And that PM of ours was soooo 'sangkut' when he spoke on TV to defend his DNA bill. He also cannot understand what the **** he was on about being in the public interest and all that crap, and so had great difficulty in speaking coherantly! And he expect us to support that bill??? What a moron!


Come to think about it, has anybody heard anything further of Tun M and family migration plans? I mean, have they decided on any particular country yet?

BREAKING NEWS! 2 Perak exco member from PKR has been detained by ACA for alledged corruption. I refuse to believe at first, thinking that it just a ploy by BN to distract attention from Permatang Pauh. But then I looked up for more information and Malaysiakini reported the story. Reason for their arrest is for accepting bribe for speedy approval for a project. I looked up for more info. Then I gor this info; the 2 excos were arrested while having tea/drink when someone unknown to them dropped a bag full of cash and voila, the ACA appears instantly and arrests them.

If anyone have more news about this, please distribute because I believe that BN is and will use any means to disrupt the oncoming by-election.

Whatever we complain about the Malaysian political and judicial system today, has been the way not just for the last few years but since the early 1980s.Many do not realise that the corruption of the judiciary was there even before Salleh Abbas was sacked. (He was part of the problem.)

I gave up on Malaysian politics since then, the purchase of NST by 4 individuals including Kadir Jasin and Halim Saad in the mid 80s was the last straw for me. I knew that Malaysia had gone to the dogs, all institutional structures had been compromised and misery is on the way. And that we must await the day to put it back on track. That day may be now.

900,000 court cases backlog; that's a huge number for a small country like Bolehland; I know of cases filed in 2001 during *****'s time, & they are still pending to this day.

This country has been destroyed - we will never be world-class like Singapore or other countries like Japan, US, Australia, etc. It's the people's fault who voted in a corrupt govt, after 50 yrs, after being told that there is a lot going-ons which are very wrong, abt the corruption, it's right into your ****-faces, yet 50% of these useless citizens still cast their votes for BN.

Unless you are a crony, relative of a crony, family members, or you have connections, there is really no reason that one shld vote for this govt. Ok, maybe a few reasons, but not enough. Think of the extent of corruption, nepotism & cronyism, is it acceptable?

I know of a lot of brain-dead ****ing idiots with live maggots wriggling inside their heads who love to say "aiyah, everywhere also got corruption"... so that justifies them returning a corrupt govt to power.

there is only one way for judiciary to reform and regain credibility, and that is by Anwar winning Permatang Pauh, and win it big! only then more MP's from bn dare to switch. if Anwar win big, not just 30 or so MP's will switch from bn but could be double that figure (at that time Anwar might need to reject some of them).

I believe to the rest of the world, Malaysia live to its motto "Malaysia Boleh". It means, Malaysia can. Although the intention was good but I think the politicians take it way too far. Can for everything and anything.

While we are still hoping for a major reform to our judiciary. The little steps such as back pay to those suspended judges, was gladly welcome by Malaysian. Actually, this was nothing to do with reform. We want to see major reform and those guilty culprits as identified by the royal commission should be brought to justice. Purge all corrupted judges, government officers and replaced them with those efficient and sincere government officers or recruit professionals from private sectors.

While we are still HOPING... Our government came with another idea. Swear to Quran. Assuming this is acceptable, then why is it those advocating for this not asking the others to swear to Quran. Such as those identified to be involved in Altantuya murder and many corruptions cases. Why having such double standard? Please keep religions out of your politic. Do not attempt to corrupt them.

I believe Rakyat Malaysia are fedup with the mockery made by those in power. Maybe many years ago Malaysians can be fooled but not today. Malaysians want serious politicians to run the country. Malaysians want serious professionals to run the government agencies. Malaysian want unity and not racial disharmony. This warning are for all politicians in both BN and Pakatan.

Stop monkeying one another and get down to serious business.
We want development.
We want reform.
We want peace.
We want progress.

Someone mentioned P Ramlee. Please do not compare P Ramlee with all the *******s mentioned here. He has proved his greatness and until today no Malaysian actor or actress has come close to the level of greatness he has achieved.
