Anybody with even a casual interest in corporate Malaysia would have heard of Tan Sri Megat Najmuddin Megat Khas. After all, he is chairman of four listed companies and a director of three others, all in a non-executive capacity. On top of that, he has long been president of both the Federation of Public Listed Companies and the Malaysian Institute of Corporate Governance. A lawyer by training, he is also a veteran Umno politician and sits on the party’s disciplinary board.

Why did you publicly advise your former schoolmate, Raja Petra Raja Kamarudin of the Malaysia Today website to “come back and face the music” recently? – Paul Lee, Kuala Lumpur

He was a junior schoolmate at the fully residential Malay College Kuala Kangsar (MCKK). He has made allegations, some of which are really grave allegations, but he has yet to prove these allegations according to accepted criteria for proof. Going abroad and hurling unsupported allegations from afar would not do him any good. Don’t make a mockery of the law. Come back and be responsible for your allegations like a man. We were brought up at school to be gentlemen. He should face the court with whatever facts and witnesses at his disposal and convince the court that he is right. Justice is a two-way traffic. He will earn our eternal respect and mine, most of all, if he is willing to do that!

I want to respond to the one question that relates to me. I can, if you wish (and may even do that later), respond to all ten questions -- like I did recently to Shamsul Akmar of the New Straits Times. But then, considering how cheong hei I can be, this piece will probably run into so many pages. Therefore, let me talk about this one question and the answer Megat gave.

This is what Megat said: “…..but he has yet to prove these allegations according to accepted criteria for proof…..Come back and be responsible for your allegations like a man…..He should face the court with whatever facts and witnesses at his disposal and convince the court that he is right.…..He will earn our eternal respect and mine, most of all, if he is willing to do that!”

I think Megat just does not get it. Is he so naïve or just pretending to be stupid? As a lawyer, how can he talk that way? Lawyer ini macam cakap ke?

I have said this before and let me say it again. I do not need to prove anything. I have been arrested and charged and put on trial. It is the Prosecution that needs to prove my guilt. The onus is on them to offer the evidence and bring forward witnesses to prove my guilt. All I have to do is to raise reasonable doubt. And if I succeed in doing that, then the court MUST give me the benefit of the doubt and declare me innocent.

Megat never once walked into court to attend or witness my many days of hearings. If he did then he would probably have spoken more like lawyer and would not have made that very embarrassing statement, which reflects very badly on his abilities and qualities as a lawyer.

An accused person has the right to defend himself in any way he sees fit. Whether it is a brilliant or stupid defence is not for the court (and certainly not for the Prosecution) to decide and interfere in. But when the court blocks certain evidence from surfacing or certain witnesses from being called to testify, then the accused is being denied his right to a proper trial.

If the court wants to fuck around with me then why should I bother to layan (entertain) the court? I am telling the court and the government to go to hell. If they want to play fair then I will play ball. But if they fuck around with the legal system then I walk away.

What is so difficult for Megat to understand this? I am telling the court that if they fuck me then I will tell them to go fuck themselves. Megat can’t even get this through his thick head?

About the other remarks -- “come back and be responsible for your allegations like a man, he should face the court with whatever facts and witnesses at his disposal and convince the court that he is right, he will earn our eternal respect and mine, most of all, if he is willing to do that!” -- again, I think Megat is missing the plot here.

“What maketh a man?” as Shakespeare would probably say if Megat were to address this statement to him. Meekly walking into court without a fuss and bending over so that the court can screw you in the arse is a mark of a ‘man’? I would have imagined that his MCKK education would have made him smarter than that. I can only say that the MCKK education was wasted on him.

It appears we have different ideas about what being a man means. Megat’s idea of being a man is to subject yourself to persecution and perversion of justice. My idea of being a man is never to allow yourself to be screwed in the arse by anyone -- even the government of Malaysia and the Malaysian judicial system -- and if they try to, then turn your back on them, show them your arse, and tell them to go screw themselves.

Different strokes for different folks, as they say. So, being a man to Megat’s perspective is being a mouse as far as I am concerned. Being a man, to me, means the courage to say “No!” And that is what I am telling the Malaysian government and the Malaysian judicial system -- “No! No! No!”

Oh, and what makes Megat think I need to earn his or anyone’s 'eternal respect'? Does he think I am doing all this to make a name for myself? Seriously, I do not care one bit what Megat and any of the other Umno and Barisan Nasional people think of me. Their opinion of me does not matter one bit.

My objective is to try to bring down Barisan Nasional and Umno in any way possible. Barisan Nasional’s and Umno’s objective is to try to stay in power -- by hook or by crook, by fair means or foul. To Barisan Nasional and Umno, anything is fair game, even racism and religious strife. Just a few days ago, Jakim told hundreds of participants in its lecture that another May 13 is looming over the horizon. Umno is going round the country telling its members that there is soon going to be a ‘civil war’ in Malaysia.

Is Megat saying that Barisan Nasional and Umno are noble and honourable and I am not?

I really don’t care what people say about me and what they think about me as long as I can fight and beat Barisan Nasional and Umno at its own game.

So, Megat, I really don’t care a damn what you and your Umno people think of me. Seriously, if you and Umno love me then there is something wrong here. That means I am not doing my job. Only when the entire government, Umno and Barisan Nasional hate me and wish to see me dead would that mean I have done my job.

That is my mission. And regard this as my mission and vision statement.

Megat was of course was speaking from a lofty position. It would be different if he had placed himself in RPK's shoes. His Malaysian conscience has not hit him yet. Maybe never. Otherwise he would not have said what he had said of RPK.

Megat had become an UMNOputra a long time ago. Because of crony connections, UMNOputras like him would continue to benefit from UMNO at the expense of other Malaysians, including lesser Malays. They would not sacrifice their comfortable positions for the sake of public benefit. What they do for public consumption is largely ceremonial and superficial.

Megat is perceived as nothing more than another loyal servant of corrupt and arrogant UMNO. It's unlikely he can see eye to eye with RPK when their life's perceptions are miles apart. Megat's objective is localised to continued personal and group benefits, is short-sighted, whereas RPK's is one of genuine national concern for a better Malaysia for all Malaysians...well, there is no promise that a good college will breed students of the same calibre...from observations, people can tell...it's obvious RPK will continue to stand tall amongst good Malaysians for sometime more...

Let me start with their "PRIVATE" carrier, MAS. When one books online flights, it asks for salutations . On the drop down pane you'll find" connections" ,not Internationally but tuned for the comforts of Tan Sri's, Tun's , Datuk's and all those who walk the corridors of power. A security guard at the departure gates may find it embarrassing to make through checks seeing the salutations on the ticket, after all they belong to a feudal state!!-----------now i know why they are willing to pay a fortune to buy those titles as Megat ! Even if they carried a suitcase full of foreign currency or C4---it will be a breeze!!!

Lawyers true to their profession are always ready to don their black robes to fight for justice -----sorry not the ones bar-coded by UMNO! Either Magat is blind or pretending to be blind so that his luxuries can be kept alive.

Wonder if he has ever entered a Malaysian courtroom, leave alone litigate to know the workings of the ""Correct "-"Correct" Malaysian Judiciary! We all know he is a lawyer who can silence any brush with the law with a single phone call as Najib did to Baginda!---("stay cool")

To further up abit on bad habits... If a person realizes he's done a mistake, and he is determined to change, would the action be soooooo mild? Only mentioning on the lips, but never put into action... For example. If a drug addict really determined to quit drugs, would he just say he's quitting while still injecting drugs into his body?

So too... if we see the actions of our B.N government... In one hand, they are speaking about harmony, unity, change, etc etc... But just take a look at their actions... the Perak case, DSAI's case, The Lingam case, etc etc.... It tends to suggest the opposite of what they claimed.

As action speaks louder than words... It is easy to see, why people are giving up on them. But I guess they can't help it... Bad habit sticks, and they are not DETERMINED to kick it.

And what Should we do to "Drug addicts" that cannot kick their addiction? I think I don't have to say here... And mind you... Some parents who knew their children are addicts, do send their children to lockups or rehabitation centres... This is not done out of hate, or disgust, but out of love... They loved their children so much they can't bear to see them tearing themselves like that...

Similarly, we loved our country soo much too that we cannot bear to see it going down.... And for that, we have to send "Corruption and injustice addicts" to jail/rehabitation...

I'm sorry to beg to differ... you see... He reached to such a stage for a reason... And I believe in this case, his "capability" to reach such position isn't through his "lawyership"...

It is too bad that in the corporate world, as well as politics, you have to know the right "keyword" to say to get access to lots of benefits. So... He, having reached that position, must've been sooooo used to such character and living style, that it is his 2nd nature now... So too, would you think it's easy for UMNO to change? 50 over years in that manner... Bad habit sticks, ok?

So.... While it is indeed necessary to bring this up, I would feel that he should be ignored... Just like that someone who's left a party but made a comeback later.... Someone who, although retired, keep telling "modified" version of hstory, who's making an image that he is an "almost" perfect person who only did one mistake when he retires... When one does his/her job,sticking to the right rules,procedures,do's and dont's and if that person remains responsible,never faltering from their duty,refuses to cross the line to join the ' who you know ' game to climb up the corporate ladder,that person would and never will be popular...That person would be the most hated for being right and downright good...Believe me when I say that I had worked for a company that simply did not appreciate good,sincere work and what is worst you would be made to be responsibility for the mistakes and inefficiency of subordinates who are the managements favourites..! Your long service in the company is often ignored and if your colour isn't right you would be sidelined to make way for the juniors to be promoted..And you would be then taking instructions from young punks who where in their diapers when you had already started working..

It would take one who feels the same to say what you said in the end of your article... "when you get the whole lot of them to hate you then your job is done "

In Malaysia many Judges do not interpret and apply the laws in the old traditional sense anymore. Politics now play a very dominant role from the lowest Magistrates Court to the apex Federal Court and they need to toe the line for the glamouraous promotion or sitting in the public-listed companies Board upon retirement. Then there are all these titles, Datuks, Datuk Seri's, etc to be conferred by the Royalties during their service to add to their long list of bunga distinctions. When all these extraneous factors come into play, who cares a damn whether Anwar or RPK gets a fair hearing? One must be thinking like any kindergarten kid if he or she believes in the justice system in Malaysia, especially when the stakes of UMNO, the Barisan or any of their vested interests are at a critical stake. Go ask Lingam or Tun M. I believe they still know best when during their days, they call all the shots. This same situation has never changed. Unless this present ruling Government is replaced.

Malaysia now in the same league as Myanmar (Burma). The judiciary and PDRM no longer independent and used unfairly to oppress democracy. The Anwar case, the arrest of lawyers, the death of TBH, the brutal force use on peaceful Rakyat holding candle vigil ....etc. There are so much in justice... blood is boiling %$#@&*.
