Two enormous cases – both widely followed locally and overseas – shared center stage on Wednesday, and both reflected the sorry state that Malaysia has degenerated into following the ascension of Prime Minister Najib Razak into the country's top job last April.

One involves Opposition Leader Anwar Ibrahim and the other the deposed Mentri Besar of Perak Nizar Jamaluddin. Pushed to the brink by the roughshod tactics of Najib’s Umno-BN coalition, both leaders had turned to the courts for 'justice'.

In the administrative capital of Putrajaya, the Federal Court shamed itself and the country with a decision that Malaysians had expected, but had still dared to hope against hope that their judiciary was not so bad after all. Surely when the crunch came, their judges would stand up for them. But it was not to be.

“It is a black day for justice in Malaysia,” DAP adviser Lim Kit Siang twittered back, announcing a 5-0 decision against the popular Nizar.

“We were already told, ‘don’t even dream Nizar can win this case, look at the people involved’. But although they may have won Perak, they have lost Malaysia,” Hanipa Maidin, PAS’s legal advisor, told Harakahdaily.

If this can happen to Nizar, what hopes for Anwar

Tens of thousands had watched the nail-biting proceedings at the Federal Court live on the Internet, where a five-man bench unanimously upheld a much challenged Appellate Court decision and declared Umno leader Zambry Kadir the rightful chief minister of Perak.

On the same morning, in the Kuala Lumpur High Court, a once-bitten-twice-shy Opposition Leader Anwar Ibrahim was taking no chances. Justice had been hijacked by trial judges during his first sodomy case in 1998, and now in 2010, he wants to pre-empt the same sort of kangaroo court and bias by disqualifying the presiding judge.

According to a member of his legal team, the sodomy trial has been adjourned to Wednesday because the prosecution objected to Anwar’s request. "Because of this, we need to file an affidavit to support our application,” the lawyer told Harakahdaily.

"Frankly, by now the people are demoralised by all the judicial shenanigans. There will be a big backlash against Umno and Najib in particular," Dr Syed Azman, head of PAS's international bureau, told Harakahdaily. 

"In their minds, people are thinking if the Federal Court can do this to Nizar in full view of the whole country and the world, what more Anwar as he is the No. 1 threat to Najib. For Umno-BN to maintain their political hegemony, Anwar must be taken down one way or another. This is what has become of Malaysia and how far we have fallen."

Najib's diabolical plot

But while Anwar can still soldier on, the curtains may have come down on Nizar, his Pakatan Rakyat compatriort who had sued Zambry for illegally usurping his position following an effort by Najib and the Sultan of Perak that culminated in his ouster.

A year ago, Najib's diabolical plot toppled Nizar’s state government, allowing the PM to install Zambry, the Pangkor MP, as the new Mentri Besar.

Nizar's team led by Philip Koh had argued that both the country and the state’s constitution do not allow a Ruler to sack the chief minister, without the backing of a no-confidence vote taken by other lawmakers in the state assembly.

“The implication from the Federal Court’s decision is that Rulers can sack an MB without reference to the House and forces outside the House can influence the Ruler to decide who should be the MB or even the Prime Minister’s job itself,” said lawyer Edmund Bon.

“How can this be right if it means one day a leader can wake up and find himself no longer the MB or PM after his rival meets up with the Ruler in the Palace?”

Nizar urges supporters to stay calm

But Malaysia’s apex court is unfazed by the hail of public criticism. Even Nizar knew he was facing an uphill battle and had requested for the maximum 11-man bench. 

But despite the importance of the case to Perak, the country’s second largest state with a population of more than 2 million, his request was flatly rejected in what observers had warned was a harbinger of the bad news to come.

Indeed, a poll conducted last week to size up the feelings of Perakians a year after the unpopular coup d’etat showed that 74 percent of the people have not forgiven Najib and still want fresh polls.

Meanwhile, Nizar and other Perak Pakatan leaders have has called for calm. They have the same number of 28 seats as the Umno-BN in the 59-seat state assembly. However, three Independents – whose statuses are still being questioned in the courts – have pledged allegiance to Umno-BN.

More than 2,000 supporters, who thronged the court, this morning took the news of Nizar's defeat badly. Shouting “Zambry pengecut” (Zambry coward), “Tipu” (cheating) and “Rasuah” (Corruption), they urged Umno to do the right thing and allow the people of Perak to choose their own leaders.

“We now challenge Zambry to dissolve the state assembly,” said Hanipa. “He should not hide behind Najib. If he is as popular as he insists, if the people want his government to stay in power as he claims, then call for snap elections. Let the people decide.”

But it is not to be!!
Well, I'm consoled somewhat that EDmund has pointed out the absurdity of the ruling against nizar..
Perhaps, 10 years down the road, a more enlightened panel will right this wrong.

So next, they will make Selangor govt fall. Within one month from now. This federal court decision will embolden their efforts. This country is screwed - with all these shit going on, everyone is not focused on issues such as GST and govt's ways & means of taxing all rakyat including poor. Many people have no F**king idea what is going on, the bigger issues that concerns money. I just bought a loaf of bread, up 20sen! To me it's no big deal, but to millions of others, it is. In fact, come March 1st or May 1st, petrol price will go up, by how much is irrelevant. But across the board, prices of everything else will increase. The worst thing is, crude oil price on world market is hovering at around USD71 per barrel, not USD147 per barrel today. Why increase petrol price then?

This country got no hope! Never mind, let the country go to hell. With corruption unabated, it will. Look at Philippines - such a huge percentage of their population living in desperate poverty after decades of corruption - they will never get out of their predicament in a 100 years. We are headed that direction, not IF, but WHEN. Good, let this country face inevitable collapse. People who support corruption deserve to be impoverished.

A precedent has been set. A palace ousted the legitimate Menteri Besar, and that was upheld by the judges of zero conscience.

Pakatan should now find every available means to get the Agong's Palace to oust najib from his premiership.

Forget about the constitution. Forget the law. Forget justice. As long as UMNO is alive there's not going to be any adherence to the constitution or law. There's not going to be any justice left. What is more important is to see UMNO is in power till the hereafter.

But there's a solution to it. Just go around it and make sure that UMNO is dead. Yes, UMNO must be demolished, destroyed and sent to hell. In short, without UMNO there won't be anymore misrule, injustice, corruption, abuse of power and a thousand more sicknesses that came along with that party. And that's not an easy task. So, work hard. Really hard. Must educate the public, especially the voters for it had been too long that they had been mentally colonized to the extend that the majority of the Malay voters can't use their gray matter efficiently. In short they feel that they can't survive without UMNO. And that has to be corrected. If not just dream on and let UMNO rule for another century.

Surely, the malay can see that if their majority, from the combo malay+chinese+indian, can be thrashed like this, it is a real pain kick in their backside. It is simply wrong for Perak and Malaysia. The war is not lost. Grassroot work begins now. Every Malay who feel slapped in the face with this decison , must go out to do their daily walk and reach out every Malay in the kampung and explain why this is wrong and bad for Malaysia. The chinese and Indian have made up their minds long ago, but they need to talk to every Malay as well, to get them on board. When you are talking to another malay, dont forget to highlight the insult by this mob to your own race, re Anwar sodomy sham trial. Ask everyone, would you (Malay) have taken it if this insult come from MCA/Gerakan/MIC/DAP etc? Theres no ifs and buts. An insult is an insult. This is a great insult to you, your sons and daughters, Malay man.

I am VERY happy with today Federal Court decision vindicating the rightful MB of Perak to be Zombie and not Nizar.. It shows how corrupt and subservient the judiciary and the rest of BN machinery really were/ still are. I am very HAPPY too cos this evil decision shall ( HOPEFULLY ) awake up the consciences of all those few millions of unregister voters and those millions of indifference but registered voters who dun bother to vote at all.Long Live UMNO/BN for today. Long Live PR forever. Voter get Voters for PR. Start not tomorrow but NOW

What makes a snatch thieves? In my opinion, they are either drug addicts or unemployed individuals looking for easy money. In today’s Sun (8 Feb), a girl is in coma, a result of snatch thieve. Instead of shopping with her hard earned money to welcome the Chinese New Year, she is presently lying in bed unsure of her faith. The police are unable to apprehend or to prevent snatch thieves which usually prey on the weaker sex or the elderly. However police most efficient to disperse peaceful candle vigil or to arrest lawyers.

I feel the Malaysian populace is presently a victim of snatch thieves of another level. UMNO and BN has been snatching Rakyat money to enrich themselves PKFZ, Submarine commission, over priced projects, Disneyland holiday etc. These UMNO & BN snatch thieves are no different than the low life snatch thieves on motorcycle and likewise, the Police unable to apprehend or to prevent these UMNO and BN snatch thieves.

On page 13 in the Sun newspaper (8 Feb) an article by Citizen Nades, highlights RM17 million wasted on a flop event, the Championship Youth Cup (CYC) plus another RM550 million spent by NSC with no accountability and nothing to show for. What a waste of money and to think every year I have to pay my income tax to enrich a few. At the same time I have to save up on education (currently in a coma) for my children, which the present government has failed to provide for (unless you are a UMNOputra). Blood is boiling %$#*&^%

Therefore the only solution is to change this racist and corrupt government and to restore the Judiciary, PDRM and the AG office to ensure there is a check and balance + good governance. We need a government that serves all Malaysians regardless of race. Vote for a better government in the next GE and sent the guilty to jail and to recover the millions and billons they have stolen from the Rakyat.
