Nga Kor Ming: Royal Assent Is A Must To Dissolve Perak State Assembly

If the emergency state assembly scheduled on 3 March passes the two motions, royal assent is still a must to dissolve Perak State Assembly, said former state executive council member Nga Kor Ming.

“In other words, once the first motion to reaffirm support to Datuk Seri Mohammad Nizar Jamaluddin as Perak Mentri Besar is passed, the second motion would be to ask the state assembly to commision Nizar to have an audience with Sultan of Perak Sultan Azlan Shah, seeking dissolution of the state assembly,” he said.

Nga told Sin Chew Daily Sunday (1 March) that the Sultan still holds the power to dissolve the state assembly. Thus, the state assembly can only be officially dissolved with a royal assent. Meanwhile, the Election Commission (EC) must hold an election within 60 days. Pakatan Rakyat would not interfere in the EC's decision on the date.

He said that once the support Nizar motion is passed during the emergency state assembly, BN will have to declare its fall of power and only Pakatan Rakyat will be the legitimate state government. And the power can be returned to the people after the royal assent is granted.

He added that in dealing with Selangor Exco Elizabeth Wong's resignation issues, Sultan of Selangor has demonstrated a good example of no “interference in politics from royal family”. Therefore, he believed that Sultan of Perak will as well uphold the Constitutional Monarchy System and agree to dissolve the state assembly.

Question: What are you going to do if someone stops the emergency state assembly?

Answer: After the incident in which Umno Youth members barged into the Parliament, in order to prevent someone from making trouble on that day, the Speaker has called the Perak Police Chief Datuk Zulkifli Abdullah on Friday (27 Feb), asking him to send police officers guard outside the state assembly hall on 3 March, in order to maintain order and to protect the speaker, as well as state assemblypersons.

If they do not send any police officer on that day, it means they have lost their credibility.

Q: How about if the emergency state assembly turns into a chaos?

A: In order to prevent any physical confrontation during the meeting, the Speaker has the power to allow police officers enter the assembly hall, or send more security guards to maintain order.

There will be recording for the assembly on that day and thus, any violence act would be shown to the world.

Q: How the Speaker arrange the seats for Pakatan Rakyat's and BN's assemblypersons?

A: The seats are going to be arranged in accordance with Article 2 of the Standing Order. The ruling party will sit on the right while the opposition will sit on the left of the Speaker.

From the beginning until now, Nizar is still a legitimate MB. Thus, Pakatan Rakyat will sit on the right and BN on the left of the Speaker.

The names of the assemblypersons will be displaced on the table and they just have to take their seats accordingly. There are seven assemblypersons being banned from the assembly and thus, their names will be be displaced on the assemblyperson seats. If they still turn up, they can only be onlookers and sit at the public enclosure.

Q: What if BN assemblypersons do not accept the passed motion?

A: The state assembly is the highest legislative body. Any passed motion in the state assembly must be obeyed. BN has no choice but to accept it. Otherwise, they would have to charged for defying the state assembly and become a mockery. They would be regarded as non-compliance with the rule of law.

A: Pakatan Rakyat is the people elected state government. Anything Pakatan Rakyat did, we did it to defense democracy and public opinions. Pakatan Rakyat would not stay for another minute if we are not elected by the voters.

Once the reaffirm support to Datuk Seri Mohammad Nizar Jamaluddin as Perak Mentri Besar motion is passed, Pakatan Rakyat will insists on dissolving the state assembly and return the power to the people. How could you say Pakatan Rakyat is power-addicted?
