Three senior judges to be moved out soon


(Free Malaysia Today) – Three independent minded judges who have been making rulings unfavourable to the Barisan Nasional government are expected to be transferred out of the High Court’s  Appellate and Special Powers division soon.

They are due to be moved to the High Court’s Commercial Division.

The three, named in the latest edition of Parti Keadilan Rakyat newspaper Suara Keadilan, are Justice Datuk Alizatul Kair Osman Khairuddin, Justice Lau Bee Lan and Justice Mohamad Ariff Md Yusoff.

The paper quoted court insiders as saying that they will be transferred this month and will no longer be able to handle  any politically linked cases.

One of the latest High Court rulings made by Justice Alizatul was in the Kota Siputeh case where Barisan’s Abu Hassan Sarif was declared no longer the assemblyman for the state seat and the Election Commission ordered to hold a by-election.

An appeal is now pending against Justice Alizatul’s judgment.

Justice Lau heard the Perak crisis case of deposed  Mentri Besar Mohammad Jamaluddin of Pakatan Rakyat challenging  the legitimacy of  his Umno successor  Zambry Abdul Kadir and ruled that the Federal Court must determine four constitutional questions.

However, the Federal Court ordered that the case of who was the rightful Perak Menteri Besar should be heard by the High Court. The case was later  heard by a new High Court judge who replaced Justice Lau  without any reason given for changing the judge.

In what was seen as delivering a stunning rebuff to the Barisan government and the Malaysian Anti-Corruption Commission’s investigative procedures, Justice Mohamad Ariff recently ruled that MACC had no right to question witnesses in an investigation beyond normal office hours, namely from 8.30am to 5.30pm.
