Rosli Dahlan’s Trial: When cornered, divert and delay

by Din Merican

I am gratified that RPK had asked readers of his Malaysia Today blog to read my posting yesterday entitled “Rosli Dahlan’s Trial: The Liar Kevin Morais buried in his lies!”. I am also pleased to note that that posting and an earlier one entitled “Lies, Lies and Lies!” have drawn considerable public interest in Rosli Dahlan’s case.

My objective in fanning public discussion is to create awareness of the lies perpetrated daily upon Malaysians. What is alarming is that these lies are even played in the courts. Therefore, I make it my mission to expose the perpetrators of these lies.

We hear of the government’s NKRA (National Education Key Result Area) in six areas of public concern. We hear of integrity being the core value of this NKRA. One of the NKRA is the eradication of corruption. We hear voices of dismay on the part of the MACC that the public does not appreciate the difficulty they face in the fight against corruption. As such, the Minister in charge of NKRA, Dato’ Seri Idris Jala has taken the MACC on a road show to educate the public of the importance and relevance of the MACC in the fight against corruption. The MACC too has gone on a public relations (PR) campaign to repair its battered image.

While all that is commendable, the core issue here is that the MACC must be seen as a credible law enforcement agency and not as a tool of oppression. The MACC must prosecute real criminals and not persecute innocent citizens!

The public’s concern is real, not illusory. They saw in Teoh Beng Hock’s case, the death of a WITNESS while under the MACC’s custody. And for what offence? An investigation into a  miserable alleged corruption of RM2,400. Then the cover-up in the Inquest. The public’s suspicion that the Inquest was just a diversion to deflect public outrage is now proven. The Inquest has indeed become just a charade especially when the Home Minister, Dato’ Hishammuddin Hussein, and the Parliament Minister, Dato’ Nazri Aziz, are seen threatening and intimidating the famous Thai forensic expert Dr. Pornthip Rojanasunand  How do you expect the public to have any faith in the MACC?

The scene is now repeating itself in the point blank fatal shooting of the 15 year old school boy, Aminulrashid. The inept IGP Musa Hassan gave press release after press release to paint the dead schoolboy as a criminal armed with a parang, while his friend who escaped was made to look like a fleeing felon. Then it turned out that the fleeing felon is himself the son of a policeman. When the boy gave a press conference of his version of the events, IGP Musa Hassan expressed anger and threatened to pull the police off the streets. That the IGP could make that threat, depicts his mentality of a bully. To pacify the public, the government  announced the setting up of an Enquiry Committee. Can the public be blamed for distrusting this as just another diversion and a charade?

That brings us to the Trial of Rosli Dahlan. This is a perplexing case of the brutal treatment of a professional. A lawyer, whose very duty is to advise and represent client. At that time, Rosli was actively involved in pursuing the case of the massive losses of RM 8 billion suffered by the national airline, MAS, against its former Chairman, Tajudin Ramli. That fact is known to the NKRA Minister, Dato’ Idris Jala, as Idris was the MD of MAS who instructed Rosli to pursue this case. In the end, AG Gani directed that the case be closed by imposing a fine!
