Yee Moh Chai a Liar?

IN view of the lie by Datuk Dr. Yee Moh Chai that he did not agree to the discontinuance of the proceedings in relation to the court case K 23-01 of 1998, I hereby release a copy of the Notes of Proceedings which are self-explanatory. 

The notes had been made available by the judge to both parties. But Dr. Yee had tried to make it seem he has nothing to do with the discontinuance and that I had unilaterally withdrawn the case.

Prior to discontinuance, discussions were held in the judge’s chambers and outside. From the discussions, I can vouch that I have never come across anyone so egocentric as Dr. Yee Moh Chai.

Court litigation is a time-consuming, tiring and costly affair. It is always my last option. But Dr. Yee’s personal attacks against me were so ferocious and malicious that I had no choice but to seek legal recourse to clear my name and defend my reputation. The 3 High Court cases were:

1. K. 23-01 of 2000 (Yee accused Yong of covering up phantom voters in 1999 elections),

2. K. 23-02 of 2000 (Yee election leaflets with caricatures of Yong distributing illegal ICs), and

3. K. 23 of 1998 (Yee allegations against Yong.

BACKGROUND

During and in the aftermath of the 1999 state elections, Dr. Yee had made false allegations that I was behind the issuance of fake identity cards to illegal immigrants. Dr. Yee’s PBS leaflets even contained highly malicious cartoons of myself and the then MP, Philip Yong Chiew Lip, distributing ICs to islanders, meaning Gaya Island. After the elections, Dr. Yee had alleged that I was covering up phantom voters. These are manifestly false and defamatory allegations. Hence, these are the causes of the legal actions K. 23-01 of 2000 and K. 23-02 of 2000.

At the 1999 election petition trial brought by defeated candidate Dr. Chong Eng Leong of PBS against myself, the court witnesses called by PBS had stated that I was not involved in the fake ICs or phantom voters. The court evidence and other information had made it abundantly clear to Dr. Yee that myself and Philip Yong of SAPP were not involved in the issuance of dubious ICs to illegal immigrants. Dr. Yee chose to ignore these facts.

Why was Dr. Yee not concerned that the evidence of fake ICs given in the election petition court and many other sources point to people linked to UMNO? His older PBS colleagues must have given him enough facts, figures and information that the culprits of the illegal ICs menace are linked to UMNO, not SAPP. In fact, some of these persons detained under the ISA from 1995 to 1997 over the fake ICs were UMNO members.

K. 23-01 of 1998 concerns the so-called NBT-Warisan Harta Sdn. Bhd. issue. Dr. Yee had embarked on a personal campaign on this issue. He and four other unidentified men went to the extent of harassing a company official going to a toilet. Dr. Yee  was personally digging for incriminating facts all over the places from Kota Kinabalu to Kuala Lumpur. Obviously, he did not succeed to get any incriminating information about me because there was none. If he had got any incriminating information against me, would he hold back?

I assume he thinks he has evidence of wrong doings committed by me as Chief Minister. Under Malaysia’s anti-corruption laws, it is an offence to conceal evidence of corruption. Therefore, Dr. Yee, who is now a Minister, has a duty to provide such evidence to the authorities. If he withholds evidence from the MACC, he is committing an offence. But if he has no evidence against me, then he has been lying for the last 12 years. Now, he has to make up his mind.

SAPP Struggle

SAPP and myself have come a long way. Our past actions and decisions have stood up to public scrutiny. Along the way and with age, we have become wiser.

We are not interested in petty squabbles with egocentric persons. The personal problems of the Chief Minister and his political allies are not our concern. We are concerned over the welfare of the Malaysians in Sabah. We seek to do away with racial politics, the return of autonomy and Labuan to Sabah, Borneonisation of the civil service, the review of unfair laws and policies and the solution of the illegal immigrants problems. A good energy policy, cancellation of the coal power plant, and land reforms to return land to the people are urgent subjects that occupy our time on a daily basis.
