S’gor Speaker Teng applies to strike out Badrul Hisham’s suit

SHAH ALAM: Selangor Speaker Datuk Teng Chang Khim has filed an application at the High Court here to strike out a suit against him by sacked assemblyman Badrul Hisham Abdullah over the disputed Port Klang seat.

Teng claimed in his affidavit-in-reply, filed on Thursday, that he was protected by Article 72 of the Federal Constitution from any legal action.

He added that Article 77 of the Laws of the Constitution of Selangor, entitled “Powers and Privileges of the Legislative Assembly”, also granted him immunity from being sued as Speaker.

“Badrul Hisham’s orginating summons is scandalous, frivolous and vexatious and amounts to an abuse of the honourable court’s process,” Teng said in the affidavit, adding that the suit shoud be struck out.

Badrul Hisham had filed a suit on Jan 24 to seek a declaration that he was still the official assemblyman for the constituency and thus had the right to attend all state assembly sittings

Teng had declared the Port Klang seat vacant as of Jan 16, saying that Badrul Hisham had failed to attend state assembly sittings for six months without a valid reason.
