See you in court, DAP tells Registrar of Societies over refusal to recognise office-bearers

The DAP will go to court to challenge the decision of the Registrar of Societies (RoS) not to recognise the party’s central executive committee (CEC) elected in September last year.

Its national legal bureau chairman Gobind Singh Deo (pic) said this was because the RoS’s decision was unlawful.

“This leaves the DAP with no choice but to go to court and seek a judicial pronouncement,” he told The Malaysian Insider.

It is learnt that DAP will file for judicial review at the High Court on Wednesday to challenge the legality of the ROS’s decision not to recognise the CEC.

Gobind, who is also Puchong MP, said the DAP also believed that the RoS’s directive that the elected CEC members refrain from making decisions was without the force of law.

On December 6, the ROS had informed DAP secretary-general Lim Guan Eng of its decision in a letter.

In the letter, the RoS had also advised the newly elected CEC to refrain from making any decisions on behalf of the party, stating that it was probing complaints that the September 29 re-election was not properly conducted.

Gobind said the RoS had made the decision without first informing the DAP of the details of the complaints nor did it give the party an opportunity to respond.

He said on December 20, the DAP had written to the RoS asking it to explain under which provision of law its decision was based on.

“The DAP made it clear in that letter that it will not be bound by decisions which did not have the force of law and should the ROS fail to provide an  explanation, the DAP, given the far reaching consequences of such a decision, will take the matter to court,” Gobind said.
