Is it game over for Khalid?

If he is sacked from PKR and still wants to remain as the Menteri Besar, he has a few options open to him

Tomorrow, Selangor Menteri Besar Khalid Ibrahim has to appear before the PKR’s Disciplinary Board, which will decide whether he has breached the party rules and hence should be sacked from the party.

If he does get the sack, Khalid will become an independent state assemblyman.

Can an independent state assemblyman continue as the Menteri Besar? There is nothing in the Selangor State Constitution that says he cannot.

If he doesn’t resign, the only way to get rid of him is to pass a vote of no confidence against him in the Selangor State Assembly.

PKR has 13 votes, assuming that everyone except Khalid votes against him. DAP has 14 votes because the Speaker cannot vote unless it is a casting vote in the event of a tie. So that makes 27 votes and they need 29.

We are assuming, of course, that PAS, which has 15 votes, and Umno, which has 12, do not vote against Khalid. If another two from either PAS or Umno (or both) join the vote of no confidence then Khalid would be out-voted.

Let us assume that they somehow do get the 29 votes. What then?

Pakatan Rakyat still has to request an audience with the Sultan to inform him that a vote of no confidence against Khalid has been successfully passed and ask him to appoint a new Menteri Besar.

While Pakatan Rakyat scurries about trying to get an audience with the Sultan, which may take some time, Khalid still has a few options open to him.

He can try to form a new government with various members of the four parties in the Selangor assembly — Umno, PKR, DAP and PAS. If he can get 28 of them to join him, then he can form his government.

We would probably call that a unity government.
