Top cop not obliged to find child in interfaith custody case, court rules
(TMI) – Judge Datuk Abdul Aziz Abdul Rahim said the court could not give effect to the order in a private dispute.
A Hindu mother embroiled in an interfaith custody battle today failed to compel the inspector-general of police (IGP) to arrest her former husband who is a Muslim convert and locate her daughter.
The Court of Appeal in a majority ruling set aside M. Indira Gandhi’s mandamus order to Tan Sri Khalid Abu Bakar to set in motion the high court’s orders to find and return six-year-old Prasana Diksa and arrest Muhammad Riduan Abdullah.
Judge Datuk Abdul Aziz Abdul Rahim, in allowing the appeal by Khalid and Attorney-General Tan Sri Abdul Gani Patail, said the court could not give effect to the order in a private dispute.
“The ex-wife could only enlist the assistance of court bailiff to locate the husband in order to get back the child,” he said.
