Anina files to freeze Najib’s assets, seeks detailed account of RM2.6b
(Malay Mail Online) – Former Umno leader Anina Saadudin today sought for the courts to freeze Prime Minister Datuk Seri Najib Razak’s assets, as well as a detailed account of how the RM2.6 billion donation he received for Umno had been used.
Apart from the freeze, she also wants a full declaration of all the prime minister’s assets.
Anina’s lawyer Mohamed Haniff Khatri Abdulla confirmed that his client had filed two applications this morning as part of her lawsuit against Najib, saying that these are meant to “secure all assets of Najib in the event we win the case” and to allow Umno to recover any assets if necessary.
The first part of Anina’s first application is to ask for the court to freeze Najib’s assets until her “breach of trust” lawsuit against him is decided, Haniff said, noting that the only asset belonging to the Umno president within his client’s knowledge now is his house.
“The second part of the first application is also asking the court to force Najib to declare by way of affidavit what are his assets in Malaysia and overseas in 10 days from the time the court makes the order,” Haniff told Malay Mail Online today.
Haniff said that the list of assets will have to cover all forms, including money, shares, properties, lands held by Najib or by others for him.
But the declaration of the assets will depend on whether the Kuala Lumpur High Court makes an order to grant this application, he said.
For the second application, Anina is asking for the court to enter judgment without the need to go for trial, for the full details of the transactions involving the RM2.6 billion donation since it entered Najib’s account until today.
“The second application is to ask the court to make a judgment in Umno’s favor to force or order Najib to give an account up til today what happened to the RM2.6 billion,” Haniff said, pointing out that the latter had admitted to receiving it as donation.
These two applications will avoid any decision on the main lawsuit from becoming academic if the courts decide in Umno’s favor, he said.
On August 28, Anina filed a lawsuit, which she said was done on behalf of Umno, against Najib at the High Court in Kuala Lumpur, seeking to claim a US$650 million portion of the US$681 million (RM2.6 billion) said to have been donated to Najib by a friendly Middle Eastern nation to help the Malay ruling party in its 2013 election campaign.
Hearing for the lawsuit has yet to begin and case management has been fixed for next Monday.
“I brought this ‘Najib Razak breach of trust action’ and filed these two applications for the freezing of Najib Razak’s assets and judgment for relief of the disclosure of Najib Razak’s account details, purely for the interests of the Umno that I love,” Anina said in a statement that was made available to Malay Mail Online.
The lawsuit was filed in Umno’s name through Anina against Najib and Umno executive secretary Datuk Ab Rauf Yusoh.
Anina, then the Langkawi Umno Wanita chief, was sacked from Umno by party secretary-general Datuk Seri Tengku Adnan Tengku Mansor early this month.
Last Friday, she sued Tengku Adnan and Ab Rauf in a bid to declare the termination of her party membership invalid.
