The correct way in which the Chinese must counter Hudud

History has shown that if you approach the Malays the proper way they can agree to anything. So do not tell the Malays they can implement Hudud over your dead body. Tell them Hudud is wrong. And then use the arguments above to convince them. Once the Malays realise that Hudud is not part of Islam or even mentioned in the Quran in the first place, and that Hudud is not about religion but about the Constitution, that would be the end of the matter.

Zaid Ibrahim has warned the Chinese that if PAS, in collaboration with Prime Minister Najib Tun Razak, were allowed to implement Hudud then eventually the Chinese, too, would be subjected to canning, amputation and beheading (READ HERE).

Actually this is a very clever strategy by Zaid because the best way to turn people against something is to play up the fear and/or hate factor. And if you can make people fear or hate something then you can unite them in opposition to that which they fear or hate.

Malays across the political divide would unite in opposition to what they fear as a non-Malay take-over and non-Muslims across the political divide would unite in opposition to the fear of being subjected to an Islamic State and/or Islamic laws.

So Zaid appears to know his politics and also knows the proper strategies in how to turn non-Muslims against Islamic laws such as the Syariah, Hudud, Qisas, etc.,

It is actually not that difficult to do this because most people, even Muslims themselves, do not understand the Syariah. The fact that they ask questions like what happens if there are no four witnesses in rape (how do you convict the rapist), what happens after you cut off someone’s hand and you find out later he/she is innocent of the crime (you cannot sew the hand back on), what happens if one person in that crime is Muslim and the other non-Muslim, what happens if the criminal is Muslim and the victim non-Muslim (or vice versa)? and so on.

You can explain time and again what is and is not covered under, say Hudud, and explain that Hudud only deals with certain crimes while the rest are not under Hudud. You can also explain that religion comes under the states and religious laws enacted by the state cannot override federal laws and in the event of any contradiction then federal laws would apply. Still people will not listen and will insist on their interpretation of the truth although they are wrong.

Anyway, in case any of you really do want to understand the subject you can read a short and simple thesis here: Understanding Islamic Law. That will not help turn you into a Syariah judge but at least it would help you say sensible things if you insist on talking about Islam or Islamic laws.

It appears that the non-Muslims are convinced they know everything they need to know about the subject and need not listen to any further explanation. And Muslims such as Zaid and Tun Dr Mahathir Mohamad are strengthening the non-Muslim belief about how bad Islamic laws, the Syariah or Hudud are with all the negative speeches on the subject.

I mean this is not the kafir talking. These are Muslims like Zaid and Mahathir talking. So if they say Islamic laws, the Syariah or Hudud are bad then they must be bad. Surely Zaid and Mahathir know what they are talking about and would not say something bad about Islam, Islamic laws, the Syariah or Hudud unless they are really bad.

So the non-Muslims are convinced that Hudud or any other form of Islamic laws will only be implemented over their dead bodies. And, to ensure that Hudud or any other form of Islamic laws will never be implemented, they will not vote Umno or PAS. They will only vote PAN a.k.a. Amanah. And now they will need to convince Muslims of the same thing.

There will be two things you need to convince Muslims about before they will join you to also oppose Islamic laws, the Syariah or Hudud. First would be you must convince Muslims that Islamic laws, the Syariah or Hudud are not part of Islam and are not mentioned in the Qur’an or Hadith. All these so-called Islamic laws, the Syariah or Hudud were never made mandatory by Allah and were in fact fabrications and creations of enemies of Islam long after the death of Prophet Muhammad.

Second, you must convince Muslims that Islamic laws, the Syariah or Hudud do not concern religion or Islam but are matters that concern the Federal Constitution of Malaysia. So when you discuss this matter you need to look at it in the context of the Constitution and not in the context of Islam, the Qur’an or the Hadith.

Once you can convince Muslims about these two key issues then it would be easier for Muslims to accept the argument that Islamic laws, the Syariah or Hudud have no place in Malaysia. The problem is most Muslims think that to oppose Islamic laws, the Syariah or Hudud means you are defying God. Once they realise that Islamic laws, the Syariah or Hudud having nothing to do with God, Islam or the Qur’an/Hadith, then Muslims will readily reject them and agree that Malaysia should be turned into a Secular State.

So this is the correct way in how the Chinese or non-Muslims need to counter Hudud. First get Muslims like Mahathir and Zaid to run down Hudud. It is easier when Malays rather than non-Malays run down Hudud.

Next, convince Muslims that Islamic laws, the Syariah or Hudud did not come from God and are not mentioned in the Qur’an and Hadith.

Finally, convince Muslims that Islamic laws, the Syariah or Hudud have nothing to do with religion or Islam but concern the Constitution, which is Supreme — meaning above everything else. (Article 4(1): This Constitution is the supreme law of the Federation and any law passed after Merdeka Day which is inconsistent with this Constitution shall, to the extent of the inconsistency, be void.)

Actually, if you know how to handle the Malays properly they are not really that difficult to convince. For example, once the Sultans converted to Islam the entire population followed suit and left Hinduism and Buddhism. Once the Sultans accepted the British as their Colonial masters the entire population called the British ‘Tuan’. Once the British Tuan said the only way Malaya could gain independence from Britain would be to give the non-Malays citizenship, even Umno agreed, and so did all the Rulers.
