Kit Siang is lying about Jho Low
Anyway, there are no charges yet filed against Jho Low. So why is Kit Siang saying Jho Low should return to Malaysia to defend himself? Defend himself against which charges? Can Kit Siang explain because thus far no charges have been filed?
NO HOLDS BARRED

Lim Kit Siang is lying. He said Jho Low is a fugitive. But then no charges have been filed against this so-called ‘fugitive’. How can Jho Low be a fugitive when he is not a wanted man? Not even Interpol has red-flagged him.
Has Malaysia’s Attorney-General’s Chambers filed any charges against Jho Low? What are the charges and what are the details of the crimes he has been alleged to have committed? Were the crimes committed in Malaysia or outside Malaysia’s jurisdiction?
Pakatan Harapan is saying Interpol should arrest Jho Low. First of all, Interpol does not arrest people. Their job is to link police forces of different countries, sort of like a liaison office.
Lim Kit Siang banyak sangat bohong
Contrary to the way it is frequently portrayed in popular culture, Interpol is not a supranational law enforcement agency and has no agents who are able to make arrests. Instead, it is an international organization that functions as a network of criminal law enforcement agencies from different countries. The organization thus functions as an administrative liaison among the law enforcement agencies of the member countries, providing communications and database assistance, assisted via the central headquarters in Lyon, France. So, if Jho Low is, say, in the UK, then Interpol will help the Malaysian police ‘talk’ to Scotland Yard.
But then Malaysia does not have an extradition treaty with the UK so the Malaysian police will need to file an extradition request. Jho Low can then challenge this extradition request in a UK court and Malaysia will need to prove in the UK court that Jho Low has committed a crime in Malaysia.
‘British’ Hong Kong could not extradite Lorrain from England even after a seven-year court battle
The first task would be to prove dual criminality. For example, sodomy is not a crime in the UK so if that is the crime that Jho Low has been accused of committing then the UK will not extradite him back to Malaysia.
When Hong Kong wanted to extradite Lorrain Esme Osman, the case went on for seven years and they still could not extradite him (even though at that time Hong Kong was British). Lorrain finally ‘surrendered’ and was jailed for just one year as his ‘reward’ for surrendering. So, if Jho Low puts up a fight in court, good luck to the Malaysian police. They will need to prove Jho Low’s guilt in a British court.
Lorrain died in London 26 years later on 11th August 2011
Anyway, there are no charges yet filed against Jho Low. So why is Kit Siang saying Jho Low should return to Malaysia to defend himself? Defend himself against which charges? Can Kit Siang explain because thus far no charges have been filed.
And has Jho Low not already been tried, convicted and sentenced in the court of public opinion? Even Kit Siang himself said that Jho Low is guilty like hell. So, what more is there to say? Why is there any need for Jho Low to defend himself in a Malaysian court since Kit Siang himself has already tried, convicted and sentenced Jho Low?
If Kit Siang wishes to take this case to the next level then the first thing that he must do is to ask the Attorney-General, Tommy Thomas, to file charges against Jho Low.
Kit Siang must first ask Tommy Thomas to file charges against Jho Low
Then the Malaysian police need to talk to Interpol to ask for their help to track down Jho Low.
Once Interpol has found out where Jho Low is, the Malaysian police need to contact the police in that country to seek their help in capturing Jho Low.
Once the police in that country have detained Jho Low, Malaysia will have to apply for his extradition.
Once the police of whichever country arrests him, Jho Low can challenge the extradition in court (unless they kidnap him and smuggle him back to Malaysia, which can also happen)
If Jho Low challenges that extradition in court then the Attorney-General of Malaysia will need to appoint a lawyer in that country to represent Malaysia to contest Jho Low’s application to set aside that extradition.
Can Kit Siang make sure all this is done before he opens his mouth again?
