The 1MDB “I was ordered to do it” defence is no defence

That is too bad, then. If the Cabinet knew about the RM2.6 billion donation from the Saudis, and approved it, then they are collectively responsible for any crime, if a crime has in fact been committed, and the “I was ordered to do it” defence does not get them off the hook.

NO HOLDS BARRED

Raja Petra Kamarudin

Nazi and Japanese war criminals could not escape the death sentence for killing so many people by using the “I was ordered to do it” defence. Neither could Cambodian, Serbian, etc., war criminals.

It looks like many criminals involved in the 1MDB rompakan are also using the “I was ordered to do it” defence — from managers, executives, officers, board members, advisors, auditors, accountants, bankers, and all the way down to the tea lady and toilet cleaner.

Saying “I was ordered to do it” does not excuse you from the crime or give you immunity from punishment. If not, no Nazi, Japanese, Cambodian, Serbian, etc., war criminal could be punished for just doing what they were asked to do.

If a police or army officer shoots someone dead — who has already been captured/arrested and handcuffed/tied up — because his commander ordered him to do so, he would still face a murder charge. And this applies to the 1MDB case as well.

Many people are implicated in the 1MDB rompakan. But they all plead innocence and argue that they only did what they did and the only reason they committed a crime was because ‘upstairs’ ordered them to.

That is the same argument they are using regarding the Cabinet meeting of 8th September 2010 (READ HERE: Najib Had Declared The RM2.6 Billion Beforehand Back In 2010). They say the Cabinet cannot take collective responsibility for this matter because no one dared go against the prime minister.

That is too bad, then. If the Cabinet knew about the RM2.6 billion donation from the Saudis, and approved it, then they are collectively responsible for any crime, if a crime has in fact been committed, and the “I was ordered to do it” defence does not get them off the hook.

And the same applies to the managers, executives, officers, board members, advisors, auditors, accountants, bankers, etc., all the way down to the tea lady and toilet cleaner, if they were involved in the 1MDB crime and if they only did what they did (or did not do what they should have done) “because I was ordered to do it.”
