Tommy, Tun M repeatedly violated Judicial Appointments Commission Act


(Malaysia Gazette) – The Special Taskforce report on Tan Sri Tommy Thomas’s book last week revealed that the former Attorney-General and former Prime Minister, Tun Dr. Mahathir Mohamad had repeatedly violated the Judicial Appointments Commission Act 2009 (Act 695) (JAC).

According to Najib Razak’s Facebook admin, the duo committed the offences in 2018 and 2019.

“No JAC appointment was accepted by the Pakatan Harapan (PH) government although it was a legal procedure requirement.
“The report also said that Tommy, as the Attorney-General and Chief Public Prosecutor should not be involved with the appointment of judges,” the Facebook post said.

Based on the Special Taskforce Report, on 13 June 2018, the JAC nominated Tan Sri Azahar Mohamad as the Chief Justice and Tan Sri Rohana Yusuf (President of the Court of Appeal) and Datuk Abdul Rahman Sebli (Chief Judge of Sabah dan Sarawak).

However, Tun Richard Malanjum was appointed as the Chief Justice based on the recommendation from Dr. Mahathir and Tommy, followed by Tan Sri Ahmad Maarop (President of the Court of Appeal), Tan Sri Zaharah Ibrahim (Chief Judge of Malaya) and Tan Sri David Wong Dak Wah (Chief Judge of Sabah and Sarawak).

On 18 March 2019, the JAC proposed for Ahmad to be the Chief Justice while David (President of the Court of Appeal), Tun Tengku Maimun Tuan Mat (Chief Judge of Malaya) and Tan Sri Abang Iskandar Abang Hashim (Chief Judge of Sabah and Sarawak).

However, at the recommendation of Dr Mahathir and Tommy, Tengku Maimun has been appointed as the Chief Justice, followed by Rohana (President of the Court of Appeal), Abang Iskandar (Chief Judge of Malaya), while David was maintained as the Chief Judge of Sabah and Sarawak.
